Thebusinessratings.com provides in-depth analyses of businesses and locations worldwide through AI-generated reports, business location pages, and analytics reports (the “Services”). These Services are available to Users who purchase memberships. The Platform also offers specialized Analytics Reports to business owners, providing data and suggestions for business improvement.

3. AI-Generated Content and Limitations

You acknowledge and agree that the information presented in our reports, analyses, and business location pages is generated using artificial intelligence. While we strive for accuracy, we cannot guarantee that the content is 100% exact or perfectly reflects the real-world characteristics of the businesses and locations.

We utilize various tools in an effort to create a comprehensive and realistic representation of businesses and places. We make significant efforts to eliminate errors and inadequacies through manual verification of each entry and report. However, errors and inaccuracies may still occur.

4. Data Sources and Disclaimer

The data we provide represents an objective collection of information gathered anonymously from various online sources, including social platforms (e.g., Facebook, Google, LinkedIn), websites, blogs, media content (written, video, and images), and other online resources.

You acknowledge and agree that thebusinessratings.com is not responsible for the accuracy, completeness, or reliability of the information, data, and conclusions available on the Platform. We cannot be held accountable for any consequences arising from your reliance on this information.

5. Report Generation Timeframe

While we aim to complete analyses and generate reports within 48 hours, the complexity of the tasks and the multitude of tools involved may occasionally result in longer processing times, potentially up to 72 hours or more. Such delays are considered rare.

6. Membership and Payment

Access to certain features and content on the Platform requires a paid membership. You agree to pay all applicable fees associated with your chosen membership plan. All fees are non-refundable, except as expressly stated in our Refund Policy (see Section 14). We reserve the right to change our membership fees at any time, with notice to you.

7. Listing and evaluating a new business into the platform

The business location you submit for evaluation and listing on our platform must already be registered on Google Maps platform and have a minimum of 25 reviews. If either of these requirements is not met at the time of submission, the location will not be considered for evaluation and listing. These requirements are mandatory.

8. User Accounts

You are responsible for maintaining the confidentiality of your account credentials (username and password) and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account.

9. Acceptable Use

You agree to use the Platform and Services only for lawful purposes and in a manner that does not infringe the rights of others or restrict or inhibit their use and enjoyment of the Platform. Prohibited conduct includes, but is not limited to:

• Posting or transmitting any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable.
• Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity.
• Interfering with or disrupting the operation of the Platform or the servers or networks used to make the Platform available.
• Collecting or harvesting any information about other users of the Platform.
• Using any robot, spider, scraper, or other automated means to access the Platform for any purpose without our express written permission.

10. Intellectual Property

The Platform and its content, including but not limited to text, graphics, logos, images, and software, are owned by or licensed to thebusinessratings.com and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, modify, distribute, or otherwise use any of the content without our prior written consent.

11. Disclaimer of Warranties

THE PLATFORM AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE PLATFORM IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

12. Limitation of Liability

IN NO EVENT SHALL thebusinessratings.com BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM OR SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER, AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE PLATFORM.

13. Indemnification

You agree to indemnify and hold harmless thebusinessratings.com, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys’ fees and costs, arising out of or in any way connected with your access to or use of the Platform or Services, your violation of these Terms, or your infringement of any intellectual property or other right of any person or entity.

We may terminate your access to the Platform at any time, with or without cause, and with or without notice. You may terminate your membership at any time by following the instructions on the Platform.

15. Refund Policy

Normally, we do not offer refunds for any of our services within our platform, thebusinessratings.com. All membership fees and payments for reports or other services are considered final.

However, if you believe a refund is warranted for a specific payment, please send an email to contact@thebusinessratings.com with a detailed explanation of your request. We will review your request and respond to you as soon as possible.

Please note the following regarding refund requests:

• Refunds are granted at the sole discretion of thebusinessratings.com.
• Submitting a refund request does not guarantee that a refund will be issued.
• We may request additional information or documentation to support your refund request.
• Our decision on your refund request is final.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Romania without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms shall be resolved through binding arbitration in accordance with the rules of this country.

17. Changes to These Terms

We reserve the right to modify these Terms at any time. We will post any changes on the Platform, and your continued use of the Platform after the posting of changes constitutes your acceptance of the revised Terms.
